Bylaws: Village of Port Perry

More than 200 bylaws passed by councils of the Corporation of the Village of Port Perry were lost in the devastating fire which destroyed the entire downtown, on July 4, 1884.
ON THIS PAGE MANY OF THE EARLY VILLAGE OF PORT PERRY BYLAWS FORMULATED FOLLOWING THE FIRE ARE FEATURED:
Bylaw 207 A bylaw to amend the fire limit bylaw and to make further provisions. The Corporation of the Village of Port Perry enacts as follows:
1. That from and after the passing of this bylaw no building shall be constructed of material other than such as the outer walls of which shall be of solid brick, stone or iron or partly of tow or more of such materials within that certain area described as follows: Water Street on the west side from Mary St. to Queen St.; Queen St. on both sides from Water St. to John St.; and Perry St.. on both sides from North St. to Mary St. or within one hundred feet of the limits of the said portions of streets within the said area.
2. No building of wood shall be constructed within thirty fee of any buildings that may be constructed within the said area, nor shall any of such last named buildings be carried or constructed to within thirty feet of any wooden buildings.
3. Wherever any wooden building shall be or hereafter be constructed upon any lots or part of lots fronting on the said parts of streets there shall be placed upon the outside of all windows and doors of any building that may be constructed in conformity with this bylaw, and facing any such wooden building - solid iron shutters or doors as the case may be.
4 No wooden building shall be in any way connected by wood with any such brick, stone or iron building.
5. Any building constructed in violation of this bylaw shall be forthwith removed by the owner thereof upon notice upon behalf of this corporation or by any ratepayer and in default the same my be removed under the direction of the council of this corporation by any officer thereof who may be directed by resolution of council with such assistant and assistants as he may require and the costs thereof shall be borne and paid by such owner and in default of payment the same shall be charged against he lands upon which such building or buildings my be constructed and shall be collected in the same manner as other municipal taxes.
6. The former bylaw of the Corporation respecting Fire Limits is hereby repealed except only as to matters done thereunder or in violation thereof and for such last named purposes the said Bylaw shall remain in full force and effect. Bylaw 208 A bylaw to divide the Village of Port Perry into polling subdivisions and to perpetuate the bylaws in that behalf destroyed by fire. Passed July 18, 1884.
Bylaw 209 A bylaw to amend bylaw 207. Passed July 18, 1884.
Bylaw 210 A bylaw respecting livery stables, billiard and bagatelle tables and bowling tables. Livery Stables:
1. No person shall keep any livery stable or horses, cabs, carriages, omnibuses, or other vehicles for hire within this corporation without first paying on or before the first day of march in each year a License fee of $25.00. Billiards etc.:
3. No person shall keep for hire or gain directly or indirectly or have in his possession or on his premises any billiard or bagatelle table or bowling alley or shall keep or have billiard or bagatelle table or bowling alley in a house or place of public entertainment or resort whether such billiard or bagatelle table or bowling alley is used or not without having first paid therefor the annual license fee following, on or before the 1st day of March in each year. For a single Billiard Table $50.00 For each additional Billiard Table $25.00 For each Bagatelle Table $40.00 For each Bowling Alley $50.00
4. any person who shall contravene any of the provisions of this bylaw shall upon conviction, by any one justice of the peace, forfeit and pay a fine of not less than $10.00, nor more than $40.00 and costs, and in default of payment the same shall be levied by distress and sale of his goods and chattels and in default of sufficient distress he shall be committed to the common gaol at Whitby for 20 days unless such fine and costs and costs of conveying same be sooner paid. Bylaw 211 A bylaw respecting Exhibitions, shows, etc. Passed July 18, 1884.
Bylaw 212 A bylaw to define the height and description of lawful fences. Passed July 18, 1884.
Bylaw 213 A bylaw to regulate and restrain the running at large of certain animals and to regulate pounds and poundage fees. The Corporation of the Village of Port Perry enacts as follows:
1. It shall not be lawful for any horse, bull, swine, sheep, goat, cattle or poultry to run at large in this village except as hereafter provided.
2. All milch cows that are not breachy shall be allowed to run at large from seven oÕclock in the morning to eight oÕclock at night form the first day of May to the first day of December in any year.
3. There shall be one pound for this village and the same shall be the yeard attached to the Town Hall.
4. Robert McKnight is hereby appointed poundkeeper.
5. If not previously replevied the pound keeper shall impound any horse, bull, ox, steer, cow, heifer, calf, sheep, goat, pig, goose or other poultry distrained for unlawfully running at large or for trespassing and doing damage, delivered to him for that purpose by any person who has distrained the same. Bylaw 214 A bylaw respecting public morals within the Corporation of the Village of Port Perry. The Corporation of the Village of Port Perry enacts as follows:
Placards No person shall post any indecent placards, writings or pictures, or write any indecent word or make any indecent picture or drawing on any wall, fence, street or public place within this corporation.
Drunkenness No person shall be drunk, or disorderly or profanely swear or use obscene blasphemous or grossly insulting language, or commit any other immorality or indecency within this corporation.
Lewdness No person shall keep any disorderly house or house of ill fame within this corporation.
Gaming No person shall keep any gambling house or have any farobank, rouge et noir, roulette table or other device for gambling within this corporation. It shall be lawful for any constable or other peace officer or citizen to seize and destroy any farobank, rouge et noir, roulette table or other devise for gambling found within this corporation.
Horse Racing No person shall race or speed any horse on any street within this corporation.
Indecent Exposure No person shall publicly expose his person or make any other indecent exhibition within this corporation.
Bathing No person shall bathe or wash the person in the water of Lake Scugog fronting on the limits of this corporation between the hours of seven oÕclock in the forenoon and nine oÕclock in the afternoon.
Any person who shall contravene any of the provisions of this bylaw shall be liable to the penalty following: For any offence under the first, second, fifth, sixth or seventy sections hereof, a sum not less than $1.00 and not exceeding $5.00 and costs. For offense under the third or fourth sections hereof a sum not less than $10.00 and not more than $30.00 and costs. Bylaw 215 A bylaw to appoint a local Board of Heath for this village. Passed August 4,1884
Bylaw 216 A bylaw to access and levy the whole rateable property within the Corporation of Port Perry, a sufficient sum for the payment of all valid debts of the Corporation whether of principal or interest falling due within the current year. Sept. 2, 1884
Bylaw 217 A bylaw to provide for the borrowing or the credit of this municipality the sum of eleven thousand dollars to meet $5,000 in debentures maturing 9th Sept., 1884 and for the purpose of purchasing a Shaw Fire Engine and other necessary fire apparatus and for the raising of the said sum by the issue of Debentures and providing for repayment thereof. Bylaw 220 A bylaw to appoint a Collector of Taxes and fix his salary. Dec. 1, 1884
Bylaw 221 A bylaw respecting filth on streets, injury to property, obstruction of streets and for other purposes. The Corporation of the Village of Port Perry enacts as follows:
1. No person shall throw any dirt, filth, carcasses or animals or rubbish on any street, road, lane or highway of this municipality.
2. No person shall injure or destroy nor tie any horse to any lamp post, tree or shrub planted or preserved for shade or ornament upon any street in this municipality.
3. No person shall pull down, or deface any sign, board or written notice lawfully affixed within this municipality.
4. It shall be lawful for any constable or other peace officer to seize and remove all tainted and unwholesome meat, poultry, fish or other articles of food wherever and whenever exposed for sale within this corporation.
5 No person shall erect or cooutinue? any slaughter house within this municipality what shall be within fort feet of any public street or dwelling house within the municipality and the occupants of every such slaughter house shall forthwith after slaughtering cause all remains to be buried and the floors to be washed and cleaned.
6. No person shall ring any bells, blow any horn, or shout or make any other unusual noise or noises calculated to disturb the inhabitants in any street or public place within this municipality.
7. No person shall fire any gun or other fire arm, nor fire, nor set off any fire ball, squit, cracker or fireworks in any street, road,, lane or alley withing this corporation.
8. No person shall engage in any chivari or any other like disturbance within this municipality.
9. No person shall lead, ride, or drive any horse or cattle upon any sidewalk or other place not proper therefor within this corporation.
10. No person shall encumber or injure any animals, vehicles or other means any road, street alley, lane or communication with this corporation.
11. No person shall erect, put-on, place any doorstep, porch, railing, verandah, awning or other erection or obstruction or place or expose any goods or boxes so that the same shall project into, over or upon any street, road or other public communication within this corporation.
12. No child shall ride on the platform of any car or behind any wagon, sleigh or other vehicle and no person in charge of any such vehicles shall suffer or permit any child to ride behind the same.
13. No person shall ride upon any sleigh or toboggan nor skate upon any sidewalk upon any street within this corporation.
14. No person shall leave any horse upon any street not in charge of some competent person, or not properly tied to a post or ring.
15. Any person who shall violate any provisions of this bylaw shall be subject to the penalty following and costs. For offenses under sections 12 and 13, not more than $5.00 and not less than $1.00 For offenses under any other section, not more than $20., nor less than $1 upon conviction before any Justice of the Peace to be made and levied in the manner provided by law for offenses against bylaws. Bylaw 228 A bylaw to set apart a fund for out-of-door relief to resident poor. The Corporation of the Village of Port Perry enacts as follows:
There shall be raised annual by rate upon the taxable property in the Village the sum of two hundred dollars which said sum shall be called the "Poor Fund" and shall be applied only as directed by resolution of Council for the relief of indigent persons resident within the Corporation for burial of paupers, the supply of food and shelter to ituierant beggars and to tramps. The committee on poor to be composed of two members of the Council appointed by resolution at their first meeting in each year shall enquire into and report form time to time to the Council upon all cases of deserving aid. Date 19th day of January 1885.
Bylaw 229 A bylaw to further establish and continue the Lock-Up House. The Corporation of the Village of Port Perry enacts as follows: The Lock-up House attached to the Town Hall shall continue to be a Lock-up House within the meaning of Section 457 of the Consolidated Municipal Act of 1883, for the several purposes in the said section named. Bylaw 240 A bylaw to establish and nd regulate a public market within the Village of Port Perry The Corporation of the Village of Port Perry enacts as follows:
1. A public Market is hereby created and established in the said Village.
2. The place where the said Market shall be held and the limits within which the same shall be confined are hereby declared to be that certain building situated on the south part of the east half of Lot Number 59 and the west quarter of Lot No. 60 on the south side of Queen Street the said building fronting on Perry Street together with the road and lanes butting thereon.
4. On every Monday, Wednesday, Thursday and Saturday in each week it shall be lawful for any person to sell or otherwise dispose of any of the articles mentioned in Sec. 3, of this Bylaw in any other part or place in this Village save as herewithin after provided. On every Tuesday and Friday not being a holiday any person desiring to sell or otherwise dispose of any butter, cheese, lard, tallow, eggs, poultry, fruit, vegetables or fresh meat in quantities of not less than the quarter carcass within this Corporation shall re3sort to the said market and not elsewhere with the said products until after the hour of twelve oÕclock noon after which hours such person may sell the same throughout the village.
13. Every Tuesday and Friday are hereby declared to be pubic Market days.
15. The said market shall be opened every lawful morning at six oÕclock and closed at 7 oÕclock in the evening between the 1st day of May and the 1st day of October and during the rest of the year shall be opened a 7 oÕclock in the morning and close at 6 oÕclock in the evening except on Saturdays when the Market shall be kept open until 10 p.m.

Bylaw 281 - A bylaw to amend Bylaw No. 207. May 7, 1888
Bylaw 282 A bylaw respecting early closings. The Corporation of the Village of Port Perry enacts as follows:
1. That upon, from and after the date hereinafter appointed for this bylaw to take effect the following classes of shops shall be closed every lawful day at the hour of seven o'clock in the afternoon except Saturdays and the day next preceding a Public Holiday and shall remain continuously closed after such hour for the remainder of the day that is to say: Dry Good, Groceries, Hardware, Fancy Goods, Boots and Shoes, Harness Makers, Stoves and Tinware, Produce and Seeds.
2. Any person who shall contravene any of the provisions of this bylaw shall upon conviction before a Justice of the Peace for each offense forfeit and pay a penalty of $5.00 and costs to be made and levied in the manner required by law and in default of sufficient distress shall be imprisoned in the Common Gaol of the County for ten days unless such fine and cost be sooner paid.

Bylaw 283 To define areas and streets to be watered. The Corporation of the Village of Port Perry enacts as follows:
1. That part of Queen Street extending from the Railway track westward to the east side of the frame building on the north side of the said street - formerly occupied by J. Rolph as a harness shop and that part of Perry Street extending from the south end of the Market building northward to near the Currie block shall be watered every lawful day and kept watered so as to keep the same free from dust up to the first day of October 1888.
2. For the purpose of defraying the expense of such watering a special rate on the per foot frontage on the real property within the said portions of streets shall be levied at the time of levying the general rates for the present year. Bylaw 350 - to fix the place and appoint deputy returning officers and to hold municipal elections. Bylaw 351 To appoint a Clerk of the Village of Port Perry and to fix the salary of same. The Corporation of the Village of Port Perry enacts as follows: That Frank Merwin Yarnold be appointed Clerk of the Corporation of the Village of Port Perry at a yearly salary of one hundred and twenty dollars. That the salary of the Clerk shall commence and date from the first day of December A.D 1892. that all bylaws contrary and inconsistent herewith are hereby repealed and declared void. J. Wright, Reeve Passed 1st December 1892 Bylaw 352 To appoint a treasurer for the Corporation of the Village of Port Perry and regulate the duties and office of Treasurer and fix the salary of the same. The Corporation of the Village of Port Perry enacts as follows: That John Hambly Brown shall be appointed Treasurer of the Corporation of the Village of Port Perry and shall before entering upon the duties of the said office execute and deliver a bond to the said Corporation of the Village of Port Perry of himself in the sum of $1,000 and the bond or covenant of a reliable Guarantee company in the sum of $2,000.l for the faithful performance of his duties and for duly accounting for and paying over all moneys which may come into his hands and to the said Bond shall be annexed a condition as follows: Whereas the above (long condition) see bylaw 352 on MS 430 Reel 3) That the salary of the said John Hambly Brown as Treasurer shall be $60 dollars per annum payable upon the order or warrant of the Reeve countersigned by the Clerk. Bylaw 395 To exempt from taxation for five years certain property within the Village of Port Perry. And whereas George W. Dryden trading under the name, style and firm of "Paxton, Tate & Co." is the owner of Block ? in the Village of Port Perry known as the "Foundry" premises upon which is erected a building used as a foundry. And whereas inducement have be held out to the said firm of Paxton, Tate & Co. by certain other places to secure the business land and machinery to be located in such places. And whereas the retention and operation of the said Foundry is of great benefit and advantage to the Village of Port Perry. Bylaw 507 - to provide for the leasing of a gravel pit on Scugog Island for 99 years from Alfred and Henry Beasley The Municipal Council of the Village of Port Perry enacts as follows: That the Reeve and Clerk be authorized to sign a lease on Seven Mile Island for the term of 99 years for the sum on one hundred and fifteen ($115). Bylaw 512 - a bylaw to purchase a steam plant from the Stratford Milling Company of Stratford. Whereas the Stratford Milling Co. have agreed to furnish the Corporation a steam plant and fixtures as per their specifications signed and filed with the Clerk for the sum of $3,085. F.O.B. cars Port Perry. Dated and passed the 2nd day of June, 1903.
Bylaw 513 - to prevent spitting and depositing other filth on the sidewalks and other public places of Port Perry. The council enacts as follows: No person shall spit, or deposit any filth upon any sidewalk or upon the floor of any public building, Town Hall, Music Hall, or hall or room used for public meetings or entertainment within the limits of the Village of Port Perry. Anyone convicted of breaking this bylaw shall pay a fine of not less than one dollar and not more than ten dollars with costs, and in default of payment shall be committed for one month in the County Gaol at hard labor. A number of posters with notice of the bylaw shall be prepared, signed and posted up by the Chief of Police. Dated Port Perry June 2nd, 1903.

Bylaw 516 - to appoint a Street Commissioner and Chief Constable for the Village of Port Perry. The Municipal Council of the Village of Port Perry enacts as follows: That Robert McKnight be re-engaged by this Corporation at an annual salary of $450, payable quarterly. That his term of office shall recommence on the 1st april, 1903 That the duties of the said Robert McKnight shall be to act as Chief Constable, street commissioner, caretaker of Hall, tax-collector, sanitary inspector, pound keeper and Market clerk of the Village of Port Perry. Bylaw 518 - a bylaw to amend Bylaw 505 of the Corporation respecting Weigh Scales and Measures and the assize of Bread. Dated Oct. 6th, 1903.
Bylaw 519 - to regulate the Wharfage Rates for the Village of Port Perry. Whereas the Village possesses a wharf at the foot of Queen St. and it is desirable to regulate the use of the same. That the said wharf shall be open to the public use as a wharf - provided that all parties using the said wharf shall pay the following rates. Per scow load $2.00, or 8¢ per wagon load at option of shipper. Three days shall be allowed for unloading scow. An additional charge of 50¢ per day shall be charged for each day that material is left on the wharf. Dated the 18th November, 1903.

Bylaw 533 - a bylaw respecting the construction of sidewalks. The following sidewalks shall be constructed by the street commissioner. Cement walk from Mary St. to Casimir on Perry St, ease side four feet wide; Plank walk Mary to Casimir Streets on Perry St. on west side, three feet; Plank walk from Bigelow to Cochrane on Paxton St. south side, three feet; Plank walk from Queen to Mr. W. BrockÕs house on Ella, east-side, three feet; Cement walk about 4 rods in front of Mrs. JamiesonsÕ residence on Perry St.; Plank walk in front of Mrs. McGly??? to Jas. SissonÕs residence,; Plank walk from Rosa St. to Mr. EarchmanÕs residence on the north side, two boards. Dated the 4th day of July, 1904.

The Municipal Waterworks Act and the Municipal Light and Heat Act etc. A board of Water and Light Commissioner to take charge of the municipal waterworks and electric light system.
